Auto dealership took advantage of buyer's lack of knowledge, suit claims

HOUSTON — A suit alleges a Texas auto dealership took advantages of a buyer's lack of knowledge and ability by misrepresenting the damage and repair condition of a car they sold. 

Maria Sonia Garcia Serrato filed a complaint April 2 in Harris County Court against Lone Star Auto Sales No. 1 Inc., and John Doe Surety alleging violation of the Texas Deceptive Trade Practices Act and negligent misrepresentation.

The plaintiff alleges in the suit that Lone Star Auto Sales "misrepresented the damage and repair condition" of the used 2014 Buick Verano purchased from them on April 2, 2019. The suit also states that Lone Star Auto "took advantage" of the plaintiff's "lack of knowledge, ability and expertise" to a "grossly unfair degree" and that the plaintiff is concerned about the safety of the vehicle. 

The plaintiff claims Lone Star Auto misrepresented the value of the vehicle and that the vehicle had defects at the time of the sale which included "express warranties which gave rise to the implied warranty of merchantability and fitness." 

The plaintiff seeks monetary relief or more than $100,000 and all other just relief, interest and all other just relief. The plaintiff is represented by Vincent Renda of The Renda Law Offices PC in San Diego, California.
