HOUSTON — A Houston couple claims they lost half a million dollars in jewelry that was stolen from their home due to the negligence of their homeowners association and its contracted security provider.

Swapnil Agarwal and Deepika Agarwal filed a complaint April 18 in Harris County District Court against Universal Protection Service LP and Royal Oaks Residential Community Owners Ass'n Inc., alleging negligence.

According to their complaint, the plaintiffs live in the Royal Oaks community in Houston and pay dues that cover "security expenses" for the neighborhood which adjoins a country club. They allege that the defendants have been negligent in protecting their neighborhood which resulted in their home being burglarized on Aug. 3, 2020, and the loss of $500,000 in jewelry which was taken from their residence.

The plaintiffs claim "intrusions" into the neighborhood come from an unfenced area on the golf course which is left unprotected. They further allege that the defendants' "catch and release policy" of intruders resulted in a person being caught and then let go on the same day the burglary of their home took place.

The plaintiffs seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Hessam Parzivand of The Parzivand Law Firm PLLC in Sugar Land.
