Man who tripped over exposed drop wire sues AT&T for $1M

HOUSTON — A man is suing AT&T, Southwestern Bell and others after he tripped over an exposed drop wire in his backyard and suffered injuries. 

Jackie Merchant filed a complaint April 20 in Harris County District Court against Southwestern Bell Telephone Company, AT&T Services Inc., and The Wilkins Group Inc., alleging negligence. 

Merchant was at his home on Silverchase Meadows Drive in Houston on April 21 2019, according to his complaint.  He alleges that the defendants were doing work on his neighbor's house and failed to bury a "drop wire" that was in his backyard. Merchant claims he tripped over exposed wire, fell and suffered injuries. He alleges the defendants were negligent for failing to inspect the premises and correct any dangerous conditions on the premises. 

He also alleges the defendants failed to warn him of the hazard. Merchant claims in addition to his physical injuries, he has incurred medical expenses as well as past and future impairment. 

Merchant seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Meredith Smith and Anthony Presutti of The Law Office of Richard J. Presutti PC in Houston.
