Houston CVS Pharmacy fills woman's prescription with wrong dosage, suit claims

HOUSTON — A woman alleges a CVS Pharmacy in Houston filled her prescription with the wrong dosage which caused her to ingest double the amount of medication she was prescribed.  

Edith Johnson filed a complaint May 11 in Harris County District Court against CVS Pharmacy Inc., CVS Pharmacy Inc., doing business as CVS Pharmacy Store #6238 and others alleging negligence. 

Johnson alleges in her complaint that she was given a prescription from her doctor for 500 milligrams of Metformin HCL which was sent to the CVS Pharmacy on West Fuqua Street in Houston on May 14, 2019. She claims her prescription was mistakenly filled for 1000 milligrams of Metformin HCL which is twice the dosage her physician prescribed. 

Johnson alleges she unknowingly ingested 3,000 to 4,000 milligrams of the drug daily. She claims the defendants were negligent for failing to discover and correct the prescription and failed to ensure their pharmacists and pharmacy technicians followed polices and procedures when filling prescriptions. 

Johnson seeks monetary relief, trial by jury and all other just relief. She is represented by David Mestemaker, Norman Straub and Jonathan Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
