Former Motiva general counsel, head of litigation alleges age discrimination

HOUSTON — The former associate general counsel and head of litigation for Motiva Enterprises alleges he was terminated due to his age. 

Keith Calcote filed a complaint May 17 in Harris County District Court against Motiva Enterprises LLC alleging age discrimination. 

Calcote began working as Motiva's associate general counsel and head of litigation for Motiva in August of 2014 and previously served as senior counsel for Shell Oil, according to his complaint. 

Calcote alleges that during his six years in Motiva's legal department, he built the Motiva litigation department "from scratch" and by August of 2020, he was 63 years old and "the oldest lawyer in the legal group."  

He claims he was terminated due to his age and falsely told it was due to being "unqualified to be in his position" and that he was "ill-equipped to meet the demands" of Motiva's newly organized legal department. Calcote claims he had "15 years of unblemished service" to Motiva and was fired in a "five-minute telephone conversation" and replaced with a 31- year old sixth-year associate who had no in-house experience and "virtually no trial experience."

Calcote seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Gregg Rosenberg of Rosenberg Sproavach in Houston.
