Worker struck in head by alleged defective gate sues for $1M

HOUSTON — A worker for a pallet supplier who was struck in the head by a closing gate at a work site and suffered serious injuries is claiming negligence. 

Eduardo Naranjo Guelmes filed a complaint May 26 in Harris County District Court against Four Way Pallet Company LLC alleging negligence. 

According to his complaint, Guelmes was working for Four Way Pallet on June 24, 2019. He alleges that as he was switching trailers at Four Way Pallet's yard, the closing gate fell and struck him on the head. 

He claims that he has suffered "severe and lasting physical injuries" as a result of the accident and that Four Way is negligent for failing to provide a reasonably safe work environment. Guelmes alleges the defendants were also negligent in failing to properly assemble, maintain and inspect the gate or to implement safety policies and procedures. 

Guelmes seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Michael Pierce and Kyle Chapel of Pierce Skrabanek PLLC in Houston.
