Enraged food mart customer pushes items off counter and injuries woman, $1M suit claims

HOUSTON — A 60-year old woman was allegedly injured at her neighborhood food market in Houston when a fellow customer argued with the clerk and pushed multiple heavy items off the front counter. 

Kathy Greer filed a complaint June 7 in Harris County District Court against Michael Dalton Kelly, Blueberry Investment LLC, J&H Kadiwal Inc., and John and Jane Does 1-10 alleging negligence, premises liability and assualt and battery. 

According to her complaint, Greer, was at her neighborhood Eagle Food Market on Hiram Clark in Houston on Nov. 27, 2019. She alleges that while she was in the store, Kelly came into to the store to cash a check and got into a verbal altercation with the store clerk near the checkout window. 

Greer claims that Kelly "pushed everything off of the counter" that included a "heavy" acrylic CD holder, perfume and other items  which then hit her and caused her to suffer severe injuries. 

She alleges Kelly knowingly caused her serious bodily injury and that the premises defendants failed to bolt or secure the items down or use security measures to prevent injuries to customers. Greer further alleges that there were no security guards on the premises which "given the geographical area," was unreasonable. 

Greer seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Britney Jackson of The Potts Law Firm LLP in Houston.
