Man allegedly shoved into counter at Houston Ace Hardware store sues for $1M

HOUSTON — Ace Hardware is facing a suit after an employee allegedly shoved a man into a counter and into the store shelves which resulted in serious injuries. 

David Blythe filed a complaint June 14 in Harris County District Court against Ace Hardware Corporation alleging negligence. 

According to Blythe's complaint, while at the Ace Hardware store on Memorial Drive in Houston and attempting to get a key made on Dec. 24, 2020, a fellow employee pushed him into the counter, took his keys and then pushed him into the store shelves. 

He claims he  suffered "serious bodily injury" including physical impairment and has also incurred medical treatment expenses. Blythe alleges the negligence of Ace Hardware for the actions of their employee who had "specific intent to cause substantial injury" to him and for their "indifference" to his rights, safety and welfare. 

Blythe seeks monetary relief of between $250,000 and $1 million, interest and all other just relief. He is represented by Essay Eden of The Daspit Law Firm in Houston.
