Woman alleges she slipped on a jalapeno at Baybrook Mall, sues for $1 million

HOUSTON — A woman alleges she slipped on a jalapeno and suffered serious injuries while walking through the Baybrook Mall common area. 

Jayshell Richard filed a complaint June 30 in Harris County District Court against Baybrook Mall Series LLC alleging negligence. 

Richard claims in her complaint that she was at the defendant's shopping center, Baybrook Mall, in Friendswood on April 24, 2021. She alleges that as she walked through the common area, she slipped and fell on a jalapeno on the floor and suffered "severe" injuries to her leg, knee and other parts of her body. 

Richard claims she attempted to file a report at the mall management office, but it was closed and that there were no "signs of caution" in the area where she slipped. She also claims the defendants were negligent in failing to maintain its premises, specifically the floor and walkways and failed to inspect or correct the dangerous condition. Richard alleges she has also suffered lost wages as a result of the fall. 

Richard seeks monetary relief between $250,000 and $1 million, interest trial by jury and all other just relief. She is represented by Reese Swincher of The Daspit Law Firm in Houston.
