Costco employee allegedly struck customer with flatbed cart, suit claims

HOUSTON — A Costco customer claims she suffered serious injuries after a employee struck her with a flatbed cart.

Reina Hernandez De Gomez filed a complaint June 30 in Harris County District Court against Costco Wholesale Inc., alleging premises liability.

The plaintiff was shopping at the Costco located on Rosehill Estate Lane in Cypress on July 19, 2019, according to her complaint. She claims that she was at the cash register speaking to the manager, when a Costco employee came "speeding down the aisle" with a large flatbed cart and hit the back of her ankle and foot. The plaintiff alleges the Costco employee was not paying attention and that as a result of the accident, she also suffered disfigurement, lost wages and mental anguish. 

She further alleges that Costco, which retained control over the security and safety on the premises, knew of the risk of harm and failed to make the "unreasonably dangerous condition reasonably safe."

The plaintiff seeks monetary relief of $100,00 or less, interest, trial by jury and all other just relief. She is represented by M. Paul Skrabanek and Michael Grinsfelder of Pierce Skranbanek PLLC in Houston.
