$1M suit alleges rehab center employee was injured while trying to keep patient from falling

HOUSTON — A rehab center employee who was injured while trying to keep a patient from falling out of bed during a power outage claims negligence. 

Tammy Frank filed a complaint July 2 in Harris County District Court against SSC Houston Southwest Operating Company LLC doing business as Westchase Health Rehabilitation Center alleging negligence. 

Frank alleges in her complaint that while working for Westchase Health and caring for a patient on July 25, 2019, the facility had an unexpected power outage. She claims that one of the patients she was caring for began to lose air in a mattress which caused the patient to almost fall. Frank alleges that as she ran over to the collapsing mattress to catch the patient, she fell and landing on her knees and suffered various injuries that have required medical treatment. 

She claims Westchase failed to properly train her and avoid hazards such as assisting patients during a power outage and did not have necessary policies and procedures in place or provide a safe workplace. 

Franks seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Joshua Davis and Margaret Allbritton of The Davis Law Group in Houston.
