Dr. Pepper employee runs over customer's foot with pallet jack at grocery store, $1M suit claims

HOUSTON — A woman claims while shopping at a Kroger grocery, a Dr. Pepper employee ran over her foot with a pallet jack and caused her to suffer serious injuries. 

Ana Moreno filed a complaint July 19 in Harris County District Court against Keurig Dr Pepper Inc., DPS Holdings Inc., doing business as Dr. Pepper Snapple Holdings Inc., Kroger Texas LP and Kroger Co., alleging negligence. 

Moreno alleges in her complaint that while she was shopping at the Kroger grocery store and walking to the check-out counter, a Dr. Pepper employee drove a pallet jack over her foot and caused her to suffer injuries. 

She claims she has suffered severe pain, mental anguish, impairment, disfigurement and lost wages as a result of the accident.  

She alleges Kroger's negligence for failing to warn of the "unreasonably dangerous condition" at its store. Moreno also alleges the negligence of Dr. Pepper over its employee's failure to watch for store customers while delivering products and for failing to implement adequate safety policies and procedures.  

Moreno seeks monetary relief between $200,000 and $1 million, interest and all other just relief. She is represented by Jeffrey McCarthy and Michael Takla of McCarthy & Associates PLLC in Houston.
