Tenant sues Houston apartment complex after slipping on water leak

HOUSTON — A tenant who slipped on water from a leak under her kitchen sink at a Houston apartment complex and suffered extensive injuries is claiming negligence. 

Patricia Pennington filed a complaint July 30 in Harris County District Court against Gael Apartments LP and Lincoln Property Company alleging negligence and premises liability. 

Pennington claims in her suit that she was walking inside her Houston apartment on Aug. 30, 2020, she slipped on a wet floor that was caused by a water leak under the kitchen sink. She alleges as a result of her slip and fall, she suffered injuries to her leg which caused "severe pain and impairment" and required "extensive" medical treatment. 

Pennington claims the defendants failed to exercise reasonable care to avoid the risk of injuries, failed to use ordinary care in maintaining and inspecting its property and provide a safe condition in its living spaces. She also claims the defendants failed to have effective safeguards to warn of the defect. 

Pennington seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Jason Webster, Heidi Vicknair, Omar Chawdhary and Christian Tovar of The Webster Law Firm in Houston.
