HOUSTON — A Fiesta Mart customer alleges she slipped on a substance in the soap and shampoo aisle at a Houston store and suffered severe injuries.
Margarita de Almonte filed a complaint July 30 in Harris County District Court against Fiesta Mart LLC alleging negligence.
According to her suit, de Almonte was shopping for groceries at the Fiesta store on Airline Drive in Houston on Nov. 3, 2019. She claims that as she was in the shampoo and soap aisle of the store, she fell on a "puddle of a clear, slippery substance" that was on the floor in the aisle and suffered "severe" injuries.
The plaintiff alleges that as a result of her injuries, she has suffered physical pain, impairment, mental anguish, disfigurement, loss of earning capacity and incurred medical expenses. She claims Fiesta Mart was negligence for failing to warn of the "unreasonably dangerous condition" in their store and for failing to inspect the area or have proper safety rules and regulations to avoid injury to customers. The plaintiff also claims Fiesta Mart failed to have adequate training for their employees on how to maintain a safe premises to prevent customer injuries.
The plaintiff seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Mario de la Garza and Whitfield Logan of The de la Garza Law Group in Houston.
