Woman sues new home builder over water leaks, mold growth

HOUSTON — A Houston homeowner is suing her builder alleging after six months, her new home had water leaks and mold growth.

Minzala Mvula filed a complaint Aug. 6 in Harris County District Court against LTH Builders Fund II LLC and Loftech Homes LLC alleging negligence, breach of contract, violation of the Texas Deceptive Trade Practices Act and other claims. 

Mvula purchased a home on Laird Street in Houston for $539,900 which was constructed by the defendants with a new home contract being signed on March 25, 2020, according to her complaint. She alleges that in September of 2020, she began to notice "pools of water" in the garage and also on the inside of the home near the AC vent that became bad enough to cause water stains on the walls. 

Mvula claims the defendants initially came to inspect the leak and then after the inspection, their "contact information was no longer available." She also claims in her suit that after hiring her own home inspectors, they found  that the drain lines were plugged and that "smoke" was "pouring from the master bedroom toilet due to a dry trap" and a gap between the vent pipe and rubber shroud at the roof allowed rain water to leak into the attic. Mvula alleges that the inspection also found mold growth in the home due to the water leaks. 

Mvula seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by T. Ernest Freeman and Stuart Allen of The Freeman Law Firm PC in Houston.
