Man alleges Houston home he leased was cited by city as inhabitable

HOUSTON — A man alleges the Houston home he was fraudulently induced into leasing was cited by the city as being inhabitable. 

Jeremy McGilvrey filed a complaint Aug. 10 in Harris County District Court against Mynd Management Inc., and Hopewell Bay Holdings LLC alleging fraud, conspiracy and other claims. 

According to McGilvrey's complaint, he entered into a one-year lease agreement for a Houston property owned by Hopewell through their agent Mynd.  He alleges that he did a "virtual walk through" of the property and pointed out "some minor issues for correction." McGilvrey further alleges that Mynd advised him the home was inspected and ready for his family's move-in who would be traveling from more than 300 miles to move to the property. 

He claims that shortly after arrival to the property, he faced issues with leaks, mold, interior walls missing and severe plumbing issues and that he discovered the home had received violations form the City of Houston who cited the property as unfit for human occupancy. McGilvrey alleges the defendants made false representations that the home was safe and habitable and frauduently entered into the lease agreement. 

McGilvrey seeks monetary relief of $250,000 or less, interest and all other just relief. He is represented by Karalynn Cromeens and Iesha Dunmore of The Cromeens Law Firm PLLC in Houston.
