Wheelchair bound woman suffers fatal fall off ledge near ramp, River Oaks Plaza sued for $1M plus

HOUSTON — The estate of a woman who suffered a fatal fall off a ledge near a wheelchair ramp is claiming negligence and premises liability. 

Margarito Flores, individually and as executor of Maria G. Flores, deceased, the Estate of Maria G. Flores, deceased, Margarito Flores, Jr., Ignacio Flores and Maria L. Flores filed a complaint Aug. 26 in Harris County District Court against Anbil II-RO LP, individually and doing business as River Oaks Plaza and Anbil-II-Ro GP, LP alleging premises liability and negligence. 

According to the plaintiffs' complaint, Maria L. Flores and her mother Maria G. Flores, were at Q-Nails on West Gray Street in Houston on May 11, 2020. The plaintiff alleges that Maria pushed her mother in a wheelchair while exiting the salon and that as she pushed the wheelchair towards the ramp and crosswalk in front of the nail salon, the wheelchair fell off a "dangerously high ledge." 

The plaintiffs' claim Maria G. Flores was thrown from the wheelchair, suffered injuries and died as a result of those injuries and complications during treatment. She further claims the defendants were negligent in the design of the ramp and for allowing use of the ramp with the northern side of the ramp having a dangerous ledge without any fencing, obstruction or warning.

The plaintiff seeks monetary relief of more than $1 million, interest and all other just relief. She is represented by Gary Freeman of The Estes Law Firm PC in Richmond.
