Pizza delivery driver sues Papa Johns after fall down wet stairs at apartment complex

HOUSTON — Papa Johns is facing a negligence claim from a former pizza delivery worker who slipped on wet stairs while delivering to a Harris County apartment complex and suffered injuries. 

Riley Gallien filed a complaint Aug. 24 in Harris County District Court against HPV Staff LLC doing business as Papa Johns Pizza alleging negligence. 

Gallien was an employee at Papa Johns in Harris County, according to his suit. He claims that while delivering pizza on Sept. 3, 2019, to a customer at the Landmark Apartments and coming down the stairs from the third floor, he slipped and fell down a flight of stairs that were wet from rainfall. 

Gallien alleges he suffered severe injury to his foot and ankle that required surgical intervention. He claims Papa Johns, who did not carry workers' compensation insurance for him, failed to properly train its employees and failed to provide him with a safe place to work. 

He further claims as a result of his fall down the stairs, he suffered physical impairment, disfigurement, loss of earning capacity and incurred medical expenses. 

Gallien seeks monetary relief of more than $500,000, interest, trial by jury and all other just relief. He is represented by Larry Longer of Larry G. Longer PC in Houston.
