Framer who fell 10 feet onto first floor slab at construction site claims sues for $1M

HOUSTON — A framer at a construction site who fell 10 feet to the first floor  after stepping on unsecured plywood claims negligence for a lack of railings and other safety precautions.

Jose Sanchez filed a complaint Aug. 21 in Harris County District Court against Tri Pointe Homes Texas Inc., frequently known as Trendmaker Homes Inc., Cafe Construction Inc., Julio Alquicira and Felix Marcelino Vega alleging negligence. 

Sanchez was working as a framer at Trendmaker Homes' construction site on Aug. 22, 2019, according to his complaint. He alleges that while measuring a section of the wall on the second level of the site which had no railing, he stepped on an unsecured piece of plywood and fell 10 feet onto the first floor slab. Sanchez claims as a result of his fall, he suffered "life altering and debilitating" injuries, pain, lost wages and incurred medical expenses.  

He also claims the defendants' negligence for failing to provide a safe worksite with proper safety equipment and failed to promulgate safety regulations for second floor work. Sanchez alleges the defendants also failed to mandate railings on the second floor of the job site. 

Sanchez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Thomas Bickham, Jr., of Bickham Law in Houston.
