HOUSTON — A man claims a nail from a tank display that was left in the walkway at an aquarium in Houston caused him to suffer injuries.
Jesus Martinez filed a complaint Aug. 30 against Landry's GP Inc., Downtown Aquarium alleging premises liability.
Martinez was at the Downtown Aquarium on Bagby Street in Houston on Sept. 2, 2019, according to his complaint. He alleges that he suffered injuries as a result of stepping on a nail from a tank display that was left in the walkway.
Martinez claims the Aquarium failed to timely inspect the walkway, warn of the dangerous condition or enforce and enact proper safety protocols. He also claims the Aquarium failed to adequately supervise or train its employees in accident prevention. Martinez also claims as a result of his accident, he suffered pain, mental anguish, impairment and incurred medical expenses.
Martinez seeks monetary relief of $350,000 or less, interest and all other just relief. He is represented by Cynthia Frederick and Ronald Fitzgerald of The Frederick Law Firm in Houston.
