Couple claims negligence after adjacent property owner's contractor cuts tree roots

HOUSTON — A couple claims an adjacent property owner's contractor illegally cut and removed the roots to a large pecan tree on their property. 

David Speck and Ruth Speck filed a complaint Sept. 14 in Harris County District Court against Big Red Investments LLC and Ridgewater Homes LLC alleging negligence. 

According to their complaint, the Specks own a residence located on Omar Street in Houston which includes a "large" and mature" nearly four foot in diameter pecan tree.  They allege that the tree sits on the eastern property line of their residence which is shared with property owned by Big Red. 

The Specks claim that during construction in April of 2021, of a new home on Big Red's property, the contractor, Ridgewater, cut and removed several large roots of their pecan tree while preparing the pier and beam foundation on the new home. The plaintiffs allege the defendants' negligence in removing the roots of the "boundary tree" whose trunk was on their property and for failing to use "ordinary care" during the construction process which interfered with the interest in their land. 

The Specks seek monetary relief of less than $250,000, interest and all other just relief. They are represented by Todd Colvard of The Colvard Law Group PC in Houston.
