Man ambushed, shot in parking lot at Houston apartment complex, $1M suit claims

HOUSTON — A man is claiming the negligence of his Houston apartment complex owners and management after being ambushed and shot in the parking lot.

James Ortega filed a complaint Sept. 13 in Harris County District Court against NHM Texas Properties and Safax Properties Management LLC alleging negligence and premises liability. 

Ortega alleges in his complaint that he was returning to his apartment in the Inwood Gardens apartment complex on Fairdale Lane in Houston on May 2, 2021. He claims that he was ambushed by a man in the parking lot and was shot in his elbow and abdomen with the assailant fleeing through the broken gate in front of the apartment complex. 

Ortega alleges the defendants, who owned, operated and maintained the complex, failed to properly fix and service the entrance gates and fencing surrounding the complex. He also alleges the defendants failed to warn of the risk of criminal acts on the premises or hire security personnel. Ortega claims as a result of the shooting, he has suffered bodily impairment and disability, disfigurement, lost wages and incurred medical expenses. 

Ortega seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Muhammad Aziz and David Baluk of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner in Houston.
