Worker suffers injuries after being hit by pallet jack, $1M suit claims

HOUSTON — A man who suffered injuries after being hit with a pallet jack at Martin Preferred Foods facility in Houston is claiming negligence. 

Kerry Jones filed a complaint Sept. 13 in Harris County District Court against Martin Preferred Foods LP alleging negligence. 

Jones alleges in his complaint that on Aug. 3, 2021, one of the defendant's employees hit him with a pallet jack while unloading the pallet jacks. He claims as a result of being hit by the pallet, he suffered physical impairment, disfigurement, mental anguish, loss of earning capacity and incurred medical treatment expenses. 

Jones alleges the defendant's negligence for lack of supervision of their subcontractors and employees, failure to provide a safe work environment and failure to ensure safe operation of their machinery and vehicles. He also alleges the defendants violated local, state and federal laws and were negligent in the hiring and retention of its employees. 

Jones seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Essay Eden of The Daspit Law Firm in Houston.
