HOUSTON — A contractor who was shot in the parking lot of a hotel in Houston claims the hotel was aware of the danger on its premises due to previous criminal activity.

Walter Arevalo filed a complaint Sept. 20 in Harris Count District Court against Wyndham Hotel Management and Tah Investments LLC alleging premises liability and negligence.

Arevalo was working as a contractor to repair the roof of the Wingate by Wyndham hotel on Mills Road in Houston on Oct. 6, 2020, according to his suit. He claims that while returning to his vehicle in the hotel parking lot, "several assailants" and guests were making their way through the lobby when two of the assailants got into a fight. He claims that the assailants opened fire on each other and caused him to suffer serious injuries.

Arevalo claims that based on crime reports, earlier shooting events and lawsuits filed by other injured persons, the defendants should have known about the risk of harm. He also claims the defendants failed to have adequate security measures or warnings on its premises which had an "extensive history of criminal activity."

Arevalo seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Landon Keating of The Keating Law Firm in Houston.
