Rocks fall on man's car during pickup at building supply company, suit alleges

HOUSTON — A man alleges he suffered serious injuries at a building materials company when rocks fell onto his vehicle.

Reinald A. Warner filed a complaint Oct. 4 in Harris County District Court against Hanson Aggregates LLC alleging negligence. 

According to his complaint, Warner was picking up a load at a terminal on Adlong Johnson Road in Crosby on June 24, 2021. He claims that as the defendant's employees were loading his vehicle with rocks, an "unsecured piece of machinery" fell onto his vehicle and caused him to suffer serious injuries. 

Warner alleges that the defendants were negligent for allowing a condition on their premises that posed an unreasonable risk of harm and that they knew or reasonably should have known of the risk. He also alleges as a result of the accident he suffered physical pain, impairment and incurred medical treatment expenses. 

Warner seeks monetary relief of less than $75,000, interest and all other just relief. He is represented by Donald DeSimone of The DeSimone Law Office in Houston.
