Homeowner alleges poorly constructed balcony caused water damage, rot

HOUSTON — A homeowner is claiming negligent construction work caused a 200-pound stone from a water damaged balcony to fall onto his yard.   

Damon Spiegel filed a complaint Oct. 11 in Harris County District Court against Yago Custom Builders LLC alleging breach of contract and negligence.

Spiegel alleges in his complaint that on June 22, 2021, he was approaching the front door of his home on Barbara Lane in Houston when a 200-pound stone slipped from his balcony onto the front lawn. He claims that he then discovered the entire inside of the balcony, which was constructed by Yago in 2018, had sustained water damage and rotted. 

Spiegel alleges after contacting Yago, they agreed to repair the defective work but has now cut off contact and refuses to respond to his correspondence. He claims Yago's breach of warranty for failing to properly construct and repair the balcony. Spiegel further claims Yago failed to use ordinary care in the selection of its subcontractors or to supervise the contractors involved in the construction of the balcony. 

Spiegel seeks monetary relief of $250,000 or less, interest and trial by jury. He is represented by Kathleen Barrett James Richards of Cokinos/Young in Houston.
