Woman alleges leaked hot sauce on floor of Houston Kroger caused her fall, sues for $1M

HOUSTON — A woman alleges several bottles of leaked hot sauce on the floor of a Houston Kroger caused her to fall and suffer injuries. 

Diamond Hunter filed a complaint Oct. 20 in Harris County District Court against Kroger Texas LP doing business as K034 Kroger East/Houston alleging negligence. 

Hunter was at the Kroger on Cypress Creek Parkway in Houston on Sept. 4, 2021, according to her complaint. She alleges that several bottles of hot sauce had leaked on the floor and caused her to fall. 

She claims the defendants failed to warn of the dangerous condition and were negligent for failing to warn of the condition or make the condition safe. Hunter also claims the defendants had "actual and/or constructive knowledge" of the spill and did not "exercise ordinary care" in maintaining their premises. She alleges that as a result of the fall, she suffered pain, impairment, loss of earnings, mental anguish and incurred medical care expenses. 

Hunter seeks monetary relief between $250,000 and $1 million. She is represented by Abraham Garcia, Carlos Saldana and Brandon Kindard of The KGS Law Group in Houston.
