Costco employee sues for $1M after cutting thumb on meat cutter, alleges store failed to provide first aid kit

HOUSTON — A Costco employee who cut his thumb on a meat cutting machine is claiming the company's negligence. 

Marvin Ariel Flores filed a complaint Oct. 20 in Harris County District Court against Costco Wholesale Corporation alleging negligence. 

Flores claims that while working at Costco on Aug. 17, 2020, he was cutting meat when the meat cutting appliance he was using did not have a proper guard on it which caused him to cut his thumb. 

He alleges Costco's negligence for failing to maintain its machine in a safe condition and free from hazards, failing to warn of the dangerous condition and for failing to properly inspect the machine. 

Flores also claims Costco failed to provide a first aid kit for customer or employee use in the event of an emergency and that Costco did not properly supervise its employees. He alleges as a result of the accident, he suffered disfigurement, impairment, lost wages, mental anguish and incurred medical expenses. 

Flores seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Sam Mukerji, Jonathan Bleyer and Abraham Carreon of The Mukerji Law Firm PC in Houston.
