Workers suffer eye injuries at construction site after arc flash, suit claims

HOUSTON — A construction worker who suffered injuries to his eyes after an "arc flash" from a welder is claiming negligence. 

James Fuchs, Jr., filed a complaint Oct. 27 in Harris County District Court against Total Safety U.S., Inc., Amazon Web Services Inc., and Turner Construction Company alleging negligence.

According to his complaint, Fuchs was working on a construction project for an Amazon Web Services Inc., building as an employee of BASF on Feb. 26, 2021.  He alleges that as he and a coworker walked around the site for a daily inspection, a welder turned towards him and his co-worker and hit them with an "arc flash" and burned both of their eyes. 

Fuchs claims the work being done by the welders was at the request of the defendants and that the welding work should not have been operated without a "fire watch" helper in place. He also claims the area was not barricaded, leads and cords were strewn about the ground and that there were no signs or warnings. 

Fuchs seeks monetary relief of more than $5 million, interest, trial by jury and all other just relief. He is represented by Andrew Dao and Ajay Ketkar of Daly & Black PC in Houston.
