Suit: Austin Chevy dealer accused of deceptive trade practices

HOUSTON — An Austin Chevy dealer is being accused of deceptive trade practices. 

John Rivera filed a complaint Oct. 27 in Harris County District Court against Mac Haik Chevrolet LTD, All Out Off Road Inc., General Motors LLC and TD Auto Inance LLC alleging violation of the Deceptive Trade Practices Act.

Rivera purchased a 2020 Chevy Silverado from Mac Haik Chevrolet on Dec. 21, 2019, according to his complaint. He alleges that the vehicle had been customized with various features including modifications and upgrades to enhance the engine, navigation, sound system and interior made by All Out Off Road. 

Rivera claims that on Dec. 23, 2019, the vehicle's check engine light continued to blink causing the car to have to be towed to Mac Haik at which time he made the first $900 installment payment. 

He further claims that the vehicle's special features broke down on several other occasions which has cost him $13,500 in repairs. Rivera alleges that the defendants failed to disclose that the car's special features would affect the GM warranty and that after several attempts to fix the vehicle, Mac Haik claimed they are not responsible.

Rivera seeks monetary relief between $100,000 and $250,000, interest and all other just relief. He is represented by Mark Aschermann of Aschermann Law in Austin.
