City of Houston fire fighters injured at apartment complex sue after falling through floor

HOUSTON — Two City of Houston fire fighters who fell through an opening with no floors at an apartment complex while responding to a fire are claiming negligence.

Sarah Cobarruvias and Kyle Bornowski file a complaint Oct. 27 in Harris County District Court against MaI/BH LLC doing business as Victoria Villa Apartments and Yakov Albaz alleging negligence. 

According to the complaint, the plaintiffs were dispatched to the defendants' apartment complex in Houston on Sept. 26, 2020, while performing their duties as City of Houston fire fighters. They allege that as they searched the premises for any extension to the fire, they opened a door to enter a room and fell through an opening with no floor and suffered severe injuries. 

The plaintiffs claim the defendants' negligence for removing the floor in the apartment complex without any permits or approval and for failing to warn of the dangerous condition. They also claim the defendants had a duty to warn or protect them from the dangerous condition on their premises. The plaintiffs allege they suffered mental anguish, disfigurement, lost earnings and incurred medical expenses as a result of the accident. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by E. Troy Blakeney, Jr., of E. Troy Blakeney, Jr., PC in Houston.
