Woman slipped on bathroom floor at Houston deli and hit her head on toilet, suit claims

HOUSTON — A woman who slipped on the bathroom floor of a Houston deli and hit her head on the toilet is claiming negligence. 

Maria Benitez filed a complaint Nov. 2 in Harris County District Court against Deli Management Inc., doing business as Jason's Deli alleging negligence. 

Benitez was at the defendant's restaurant on Memorial Drive in Houston on Oct. 14, 2021, according to her complaint. She claims that while using the bathroom, she slipped and fell on the wet floor and hit her head on the toilet. 

Benitez alleges the defendant failed to have any warning signs in the area, negligently failed to maintain the restaurant's premises and failed to take any safeguards to protect customers. She further alleges the defendant's negligence for failing to correct the dangerous condition. Benitez claims as a result of the fall, she suffered pain, mental anguish, physical impairment, disfigurement and lost wages as well as incurred medical expenses. 

Benitez seeks monetary relief of no more than $100,000, interest and all other just relief. She is represented by Sidra Kahn of The Daspit Law Firm in Houston.
