Man claims he was sold car with tampered odometer

HOUSTON — A man claims he was fraudulently sold a car that had a tampered odometer. 

George Phillips and Oliver Phillips filed a complaint Nov. 2 in Harris County District Court against BMW Preventative Maintenance Inc., doing business as Bemer Motor Cars alleging negligence and violation of the Deceptive Trade Practices Act. 

Phillips purchased a vehicle from the defendants that had 42,314 miles on it and alleges that shortly after the purchase, he learned the car had "excessive wear" for such low milage. He claims that after more investigation, he discovered the vehicle actually had more than 160,853 miles and that the odometer had been "rolled back." 

Phillips further claims the defendants made "significant" repairs and work on the car prior to selling it to him and that they should have noticed the vehicle had excessive wear and were obligated to disclose that information. He alleges that he suffered the costs of repairs, out of pocket expenses, loss of use of the vehicle and mental anguish. 

Phillips seeks monetary relief of more than $250,000, interest and all other just relief. He is represented by James Blackwell of The Blackwell Law Firm PLLC.
