Harris County man alleges lost of investment funds due to breach of contract

HOUSTON — A Harris County man is alleging he lost his investment money due to breach of contract.

Ruben A. Rivera filed a complaint Nov. 8 in Harris Count District Court against Total Payment Solutions LLC and Luis Enrique Uribe alleging breach of contract and fraudulent inducement.

According to Rivera's complaint, he executed an investor agreement with Total Payment Solutions and Luis Uribe on Dec. 8, 2020, and invested $100,000 for 36 months with a total estimated return of investment of $300,000. He alleges that according to the agreement, the defendants were required to make a $4,000 monthly payment plus a $60,000 advanced payment. 

Rivera claims that the defendants failed to pay the advance as well as some of the monthly payments and are overdue $77,700. He alleges he performed his obligations under the contract and the defendants breached the contract by failing to make the required payments. Rivera further alleges Uribe was aware the material representations he made were false and that he acted upon those misrepresentations with his investment.

Rivera seeks monetary relief of less than $250,000, interest and all other just relief. He is represented by Patrick O'Hara and Romin Tamanna of The O'Hara Law Firm in Houston.
