HOUSTON — A Home Depot customer who suffered injuries while trying to load a riding lawn mower onto his truck is claiming the company's negligence.
Willie Gayden, Jr., filed a complaint Nov. 8 in Harris County District Court against Home Depot U.S.A., Inc., Phillip M. Lewis, Jeannie Doe and John Doe alleging negligence.
Gayden, according to his complaint, was at the Home Depot on Commercial Drive in Rosenberg on Nov. 10, 2019. He claims that after he purchased a riding lawn mower, a Home Depot employee placed two ramps on the back of his truck. Gayden further claims that as he drove the mower up the ramps, the Home Depot employee released the ramps before he had secured the mower into the back of his truck. He alleges that the mower fell over backwards with him still on top which caused the mower to fall on top of him.
Gayden claims Home Depot's negligence for requiring him to load the mower into the back of his truck, for failing to properly secure the ramps and failing to assist him with loading the mower. He also claims Home Depot failed to properly train or instruct its employees and failed to have proper ramps or mechanisms to safely load the equipment onto his vehicle.
Gayden seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Sherry Scott Chandler and Lewis Chandler of The Chandler Law Firm LLP in Houston.
