Pharmacist alleges she was fired for not filling illegal prescriptions

HOUSTON — A pharmacist alleges she was fired for refusing to fill illegal prescriptions and refusing to commit insurance fraud. 

Muna Al-Dahan filed a complaint Nov. 18 in Harris County District Court against Parkview Pharmacy Inc., doing business as Amex Pharmacy No. 5 and Avinash Isaac Shivshank alleging wrongful discharge and other claims.

According to her complaint, the plaintiff is a board certified pharmacist and began working at the Amex Pharmacy on Bellaire Road in June of 2009. She claims that after a change in ownership, the pharmacy began to unlawfully fill prescriptions for controlled substances. 

She specifically alleges that Shivshanker "demanded" she fill orders without written prescriptions by an authorized doctor and that the prescriptions were placed by people and physicians related to or who were friends with Shivshanker. The plaintiff further alleges that she faced harassment by Shivshanker and was fired for refusing to fill the illegal prescriptions and for not falsifying insurance claims. 

The plaintiff seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Charles Hunter and Jessica Chan of Hayes Hunter PC in Houston.
