American Furniture customer injured from collapsed mattress display, suit claims

HOUSTON — A customer who suffered injuries after a mattress display collapsed at a furniture store is claiming negligence. 

Nita Beard filed a complaint Nov. 18 in Harris County District Court against American Furniture Warehouse Co., alleging premises liability and negligence. 

Beard alleges in her suit that on Dec. 23, 2020, she was at the American Furniture Warehouse on Gulf Freeway in Webster shopping for a mattress. She claims that as she sat on a display mattress, the base support on the mattress collapsed and caused her to fall and land on her knees. 

Beard alleges that American Furniture knew or should have known of the unreasonably dangerous condition. She also alleges American Furniture's negligence for failing to maintain its premises, failing to inspect the premises and for not correcting the hazard or taking safeguards to protect customers. 

Beard claims American Furniture also failed to warn of the hazard and that as a result of her fall, she suffered pain, impairment, mental anguish, loss of earnings and incurred medical expenses. 

Beard seeks monetary relief of more than $250,000, interest and all other just relief. She is represented by Frederick McGuire of The Law Office of Frederick L. McGuire in Liberty.
