Couple claims fire damage mitigation company failed to perform contracted repairs

HOUSTON — A couple claims a fire damage mitigation company failed to perform under their contract for services. 

Carl Chaisson and Deborah Chaisson filed a complaint Dec. 7 in Harris County District Court against Mitigation America LLC alleging deceptive trade practices, fraud and breach of contract. 

The plaintiffs allege in their complaint that they hired Mitigation America on March 18, 2021, to fix fire damage done to their home. They claim that Mitigation America received "significant compensation" to do the repairs but left the work with "substantial defects left behind." 

The Chaissons further claim that Mitigation America victimized them and failed to perform the services under the contract "within adequate standards" which caused their other contracted services to be unable to be performed. The plaintiffs allege Mitigation America violated the Texas Deceptive Trade Practices Consumer Protection Act and made false and fraudulent representations which caused them to economic and other damages. 

The plaintiffs seek monetary relief interest and all other just relief. They are represented by Mutunda Osafo of The Udeshi Law Firm PLLC in Dallas.
