Suit: Man struck by vehicle by landfill worker while unloading trash

HOUSTON — A Harris County man alleges a landfill site employee struck him with a vehicle while he was unloading trash from his truck. 

Ignacio Gonzalez filed a complaint Dec. 6 in Harris County District Court against Toro Rojo Inc., doing business as Action Trucking alleging negligence. 

Gonzalez, according to his complaint, was at the defendant's Toro Rojo landfill site on East Anderson Road in Houston on Dec. 5, 2019. He claims that as he stood outside his vehicle while trying to unload trash bags from his vehicle, a landfill employee operating a motor vehicle suddenly struck him and caused him to suffer serious injuries. 

He alleges the defendant's negligence for failing to monitor its premises, failing to train its employees or have proper supervision. He further alleges the defendant's employee failed to take evasive actions to avoid hitting him or apply the brakes to avoid the collision. Gonzalez also claims Action Trucking's negligence for hiring "an incompetent, unfit or reckless driver" which created an unreasonable risk of harm to others and that Action knew or should have known of the danger. 

Gonzalez seeks monetary relief between $250,000 and $1 million, interest and all other just relief.
