Alleged intoxicated food delivery driver accused of attacking others, damaging vehicles

HOUSTON — A Houston business is facing a suit after one of their food deliverers allegedly became intoxicated while on the job and attacked others.

Samnang Savath and Daniel Lee filed a complaint Dec. 6 in Harris County District Court against Cloud Kitchens LLC and 5828 Fairdale Lane Hou, LLC doing business as Fair Food Company alleging infliction of bodily injury and other claims. 

According to their complaint, the plaintiffs own and operate Thai Lao Express on Fairdale Lane in Houston. They allege that they and their vehicles were attacked by an intoxicated employee of Cloud Kitchens who was working as a food runner. 

Specifically, the plaintiffs claim that the employee, Elvera Peets, was drinking and playing a card game with them while on the clock and when she began to lose the card game, she began hitting and scratching them, slashed their car tires with a knife as well as damaged the paint, hood and truck of the vehicles. 

The plaintiffs claim the defendants' lack of supervision of Peets caused the attack and damage to their vehicles. They also claim the defendants were negligent in hiring and and training Peets and knew or should have known that she was unqualified to work with the public. 

The plaintiffs seek monetary relief, trial by jury, interest and all other just relief. They are represented by Andrew Cobos and Nicholas Kacal of The Cabos Law Firm in Houston.
