Suit: New home builder falsely represented they owned lot, had rights to property

HOUSTON — A woman alleges the builder she hired to complete her new home falsely represented they owned the lot and had rights to the property. 

Kimberly Michell filed a complaint Dec. 13 in Harris County District Court against Titan Urban Development LLC alleging breach of contract, statutory fraud and violation of the Texas Deceptive Trade Practices Act.

Michell, according to her suit, entered into an agreement with Titan on Dec. 24, 2020, for the purchase of a new home located on West 23rd Street in Houston.  She claims the contract included the new home construction to be complete by May 28, 2021, with a closing date of June 28, 2021.

Michell further claims that more than six months past the contract deadline, the home was still not complete and that the defendant falsely represented they owned the lot at the time and had rights to the property. She alleges Titan failed to disclose its "inability" to meet the terms of the contact and that she relied on Titan's false representations when signing the contract. 

Michell seeks monetary relief of more than $1 million, interest and all other just relief. She is represented by Kathy Cheng of Cheng & Associates PLLC in Houston.
