Subcontractor who fell off roof claims he was not provided any safety equipment

HOUSTON — A subcontractor who fell off a roof claims he was not provided any safety equipment at the construction site. 

Ever Avila-Lopez filed a complaint  Jan. 4 in Harris County District Court against Golden Giant Inc., and Diverse Metal Products LLC alleging negligence. 

The plaintiff was working for Diverse on Oct. 20, 2021, to install insulation on the roof of the Indianapolis Executive Airport in Zionsville, Indianapolis, according to his complaint. He claims that a sudden high speed wind caused him to fall 25 feet onto the ground and suffer "significant" injuries to his head, neck and other parts of this body. 

He alleges the negligence of Golden who was the general contractor for the construction project as well as his employer Diverse, a subcontractor for failing to supply him with a harness or other safety equipment. The plaintiff further alleges that the defendants failed to provide a safe work environment, follow and enforce safety guidelines and failed to train and supervise their employees. 

The plaintiff seeks monetary relief of more than $1 million, interest and all other just relief.
