HOUSTON – The Astros were recently dismissed from a lawsuit brought by a season ticket holder who accused the team for breach of contract and alleged that he is owed a refund because of the shortened 2020 season.
Seeking up to $250,000 in damages, Karl Oswald filed suit against the Houston Astros on May 26 in Harris County District Court.
Court records show that on Dec. 29 Oswald filed a motion to dismiss with prejudice, stating that the parties have amicably resolved their differences.
An order of dismissal was entered the following day, court records show.
Case background
According to the lawsuit, starting in 2017 Oswald purchased season tickets from the Astros, but was never informed during the transactions that the tickets or seat licenses were not refundable.
Because of the coronavirus pandemic, the 2020 season was shortened and fans were not allowed to attend games. The Astros refunded Oswald’s tickets for 2020 but not the $80,000 he paid for the license.
In addition to breach of contract, Oswald accused the Astros of common law fraud, unjust enrichment, negligent misrepresentation and deceptive trade practices.
