Forklift operator allegedly strikes subcontractor at job site in Deer Park

HOUSTON — A forklift operator and his employer are facing a negligence claim after he allegedly struck a subcontractor worker at a job site in Deer Park. 

Juan Sanchez filed a complaint Jan. 7 in Harris County District Court against ALS Associates Inc., and Servando Suazo alleging liability, negligence and other claims. 

According to his complaint, Sanchez was working for Turner Industries on March 30, 2021, at the Hexion Inc., in Deer Park. He claims that as he was walking to the trash bins, Suazo, who was working for ALS and driving a forklift, suddenly hit him and caused him to suffer injuries. 

Sanchez alleges ALS was negligent for allowing Suazo to operate the forklift without proper training and certification, for failing to properly supervise the use of forklifts or to establish and enforce safety rules and regulations. He further alleges Suazo's negligence, failing to keep a proper lookout or honk the horn to warn pedestrians and for failing to follow OSHA standards. Sanchez claims as a result of his injuries, he required surgeries and incurred medical costs. 

Sanches seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Javier Espinoza, Lara Brock of the Espinoza Law Firm PLLC in San Antonio and Oscar Garza of The Law Firm of Oscar A. Garza PLLC in San Antonio.
