HOUSTON — A woman alleges she was injured by an intoxicated person while a guest at a Best Western Hotel in Fort Stockton.
Susana Gomez filed a complaint Jan. 6 in Harris County District Court against NJL Fort Stockton Hospitality, doing business as Best Western Plus Fort Stockton, Gladiator Energy and James Metcalf alleging negligence, Dram Shop violation and other claims.
According to Gomez's complaint, she and her husband were guests at the Best Western Plus Fort Stockton on Feb. 6, 2020. She claims that as they were unloading their bags out of the car, Metcalf, an employee of Gladiator Energy who was intoxicated, fell on top her and caused her to suffer injuries.
Gomez alleges Best Western Plus failed to protect her or warn of Metcalf's drunken conduct and that the hotel's employees knew or reasonably should have known of the dangerous condition.
Gomez also alleges the hotel's negligence for providing Metcalf with alcoholic beverages while he was obviously intoxicated. She also claims Gladiator Energy's negligence for its hiring, lack of training and lack of supervision of Metcalf. Gomez claims she suffered pain, mental anguish and impairment as a result of Metcalf's negligent actions.
Gomez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Leena Joseph of The Law offices of Domingo Garcia LLP in Houston.
