Union Pacific accused of defective safety measures at rail yard

HOUSTON — Union Pacific Railroad is facing a suit alleging poor safety measures and a defective gate at one of its railroad crossings led to injuries. 

Mildred Berry as guardian and next of friend of Terrell Michelle Thomas filed a complaint Jan. 6 in Harris County District Court against Union Pacific Railroad Company alleging negligence. 

According to Berry's complaint, Thomas was "seriously"  injured on Aug. 13, 2020, while at the Settegast Rail Yard in Houston which is maintained and controlled by Union Pacific. She claims Union Pacific's negligence for failing to provide a timely audible or visual warning of a moving train and for failing to maintain the rail yard and its warning devices. 

Berry also claims Union Pacific failed to clear visibility obstructions or inspect and repair the gates near the crossing. She alleges Thomas suffered pain, mental anguish, lost earnings, disfigurement and incurred medical treatment expenses as a result of the accident. 

The plaintiff seeks monetary relief of no more than $75,000, interest and all other just relief. She is represented by Joshua Leske of Husain Law + Associates PC in Houston.
