Take 5 Oil Change allegedly put wrong oil in truck, caused engine damage

HOUSTON — A man alleges his vehicle's engine was ruined after the wrong oil was put in his vehicle. 

Pedro Martinez filed a complaint Jan. 17 in Harris County District Court against Take 5 LLC doing business as Take 5 Oil Change #0081 alleging breach of contract, fraud and other claims. 

Martinez alleges in his complaint that he took his 2003 Ford Expedition to Take 5 Oil Change for an oil and filter change on March 25, 2021. He claims that after the service, his Ford began to make a knocking noise and that after taking the vehicle to a mechanic, it was discovered the wrong oil had been used in the truck. 

Martinez claims the vehicle's engine must be rebuilt due to the defendant's actions. He alleges Take 5 Oil has failed to compensate him for the unworkmanlike services and that their actions constitute breach of contract and violation of the Texas Deceptive Trade Practices Act. 

Martinez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Abraham Garcia, Brandon Kindard and Carols Saldana of The KGS Law Group in Houston.
