Food store worker alleges lack of training led to his hand getting caught in meat grinder, sues for $1M plus

HOUSTON — A food store worker is alleges improper training and safety equipment led to his injuries from a meat grinder. 

Walter Josue Sarmiento Aleman filed a complaint Jan. 25 in Harris County District against LH Family Investments LLC, individually doing business as HD Food Market alleging negligence. 

Sarmiento, according to his complaint, was working at HD Food Market on Veterans Memorial Drive in Houston on Jan. 19, 2022. He claims as he was processing meat using a meat grinder, his hand got caught in the meat grinder machine and severed his right thumb and right index finger. 

Sarmiento further claims he never received any training, personal protective equipment such as the manufacturer's "product pusher" or safety instructions. He alleges HD Food Market's negligence for failing to maintain a workplace free from unnecessary hazards, creating a dangerous condition and failing to use ordinary care. 

He also alleges HD Food Market had actual and "subjective awareness" of the risk and potential risk of harm from the meat grinder.

Sarmiento seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Alan Garcia and Moises Morales, III of Alan Garcia & Associates PC in Houston.
