Deceased driver, representatives face claim after tractor trailer collision

HOUSTON — A company is suing a deceased driver and his representatives after he allegedly ran a stop sign and caused a collision that totaled their tractor trailer. 

Liberty Materials INC., filed a complaint Jan. 25 in Harris County District Court Roger A. Carranza-Sanchez, deceased, Isolina Rodriguez and others alleging negligent entrustment and other claims. 

Liberty was having one of its tractor-trailer's towed on Jan. 27, 2020. They claim that as the tow truck carrying their tracker trailer was traveling on Highway 90 near Bohemian Hall Road, the defendant failed to yield the right of way at the stop sign and crossed into the tow truck's path. 

Liberty claims the defendant's car struck the tow truck and caused their tractor trailer to be totaled. They allege the defendant's negligence for failing to keep a proper lookout and failing to yield the right of way. 

They also allege Rodriguez's negligence for entrusting Carranza-Sanchez with her vehicle and knew or should have known he was a reckless, incompetent or unlicensed driver. 

Liberty seeks monetary relief of no less than $88,072.70, interest, trial by jury and all other just relief. They are represented by Chaz Klaes and Thomas Dawson of Donato, Brown, Pool & Moehlmann in Houston.
