HOUSTON — A couple alleges the home they purchased site unseen failed to match the builder's renderings.
Ariel Axelrod and Robyn Axelrod filed a complaint Jan. 28 in Harris. County District Court against Partners In Building LP (PIB) and Norwood Homes Inc., alleging fraud and other claims.
According to the Axelrod's complaint, they purchased a home in Conroe at the Stillwater Subdivision from PIB and Norwood on Aug. 19, 2021, for $1,148,301. They allege that due to COVID-19 travel restrictions, the first opportunity they had to inspect the property was on move-in day and that the verbal and written disclosures of the property including plot plan and artistic drawings did not match the home they purchased.
Specifically, the plaintiffs claim that there was no disclosure of a retaining wall on the edge of the property and a narrower driveway with inadequate turnaround than what was specified. The Alexrods claim the defendants failed to disclose material facts about the property and took advantage of the fact that they lived out of state and could not physically inspect the property.
They also claim there is no way to accommodate a wider driveway without encroaching on another property.
The Axelrods seek monetary relief between $250,000 and $1 million, trial by jury and all other just relief. They are represented by T. Ernest Freeman, Stephen Scholl and Stuart Allen of The Freeman Law Firm PC in Houston.
